Well, the lawer wanted me to make a list of the neglect that I know os going on when they are in her care.

Here is what I came up with.

Both Children often wear clothing that is tattered, dirty, or not the right size for the child. Sometimes they even wear the same pair of sox for days at a time - This is very visible, I asked Loura about the sox issue and she clams they are stained, when, you can smell them and tell they have been worn for days
Justin ( the 2 year old ) goes out of the house with just a t-shirt and pants on in cold weather, where Loura will have a sweater on - This is how he gets dropped off at my mothers house in the morning ( day care ), she as well as I have sweaters for them for when they are in our care
Nether child eats breakfast in the morning before going to school / day care. This is the case I would say almost daily - o Justin is very hungry by the time that he gets dropped off at my mothers, Scot ( 5 year old ) gets his snack at school then his next meal is Lunch
Both children are awake and have no supervision in the mornings when at their mothers. - When I went to pick them up from her at 10:00 AM one morning, I knocked on the door, no answer. So I called the house a few times and finally I got an answer. It was her live in boy friend. He said they weren’t ready and hung up. So I knocked on the door again, he opened it and stated I just woke him up, so I asked to talk to Loura, he stated that she is still sleeping. So I told him to have them ready at 11. Once I returned and picked up the children I asked Scot if they were awake when I called and he stated yes, I asked him is it often that you are awake before them?. He stated yes, we just watch TV until they wake up.
Loura does not help Scot with his school work. My mother asked her why she doesn’t help him and Loura stared she was always too busy - Once School started I found out that for the first month and a half that none of his homework was getting done. So, when I see he has new work in his backpack I take it out so I can help him and I have my mother take it to his teacher when she picks Scot up
Loura has not shown any interest in Scot’s school - Loura has not been to any PTA meetings, didn’t show to the Schools Holiday concert ( where Scot was on stage singing ), or the fall carnival. I have attended all of these events and more
Both children go days with out a shower / bath - It is very visible that this is the case, it isn’t that they got real dirty during the day, I asked Scot if he had a bath the previous day and he states no
Justin gets dropped off at my mothers in the morning with out being changed prior - o My mother tells me that often when Justin is dropped off in the morning his pull up is soaked, it is more wet then it could be if it was just changed in the morning, you can tell it is from overnight
In Feb of 2001, Loura broke this law, she wound’t let me See Scot for about a period of 3 week because she didn’t fell like it - “Parental abduction” is the unlawful taking of a child by one parent, depriving the other parent or guardian of their lawful custody of the child. Parental abduction can be performed by either parent, mother or father, custodial or non-custodial. If the custodial parent takes the child away in a manner which deprives the other parent of their court-ordered time with their child, that is still parental abduction, even though the abducting parent may have court-ordered custody
In 2001 about the same time as the above, Scot was afraid to go home at times. - When I was to take Scot back to Loura he would throw a fit in my car and not want to get out, he would try his hardest to stay in the car, he would even cry and scream. When ever I had him next I would always talk to him and ask why he didn’t want to go home. He stated it was because of her live in boy friend at the time ( she is no longer with him ). Scot stated that he would hit him. I never say any physical evidence to this.
In 2001 when I was re-hired at my current employer and I asked Loura for the children’s Social Security numbers so I can add them to my insurance, she refused. She did not want me to put them on my medical insurance, I even had a court order to do so. I had to call the Social Security office to obtain the numbers
She would leave the children with her previous fiancé all the time so she could go out. - Her fiancé at the time would be in constant contact with me on the situation, he would also often have me pick up the children so he isn’t the one being her baby sitter
She lets the children watch rated R movies as well as play video games rated T for teen or M for mature - When walking through stores with the children, when we are in the movie section Scot points out movies he has seen at his mothers house, the same goes for the video games.

Good luck man. Hope you got a good lawyer. My aunt is goign threw the sam kind of shit and worse in most cases with her soon to be ex husband and 2 kids...but her lawyer ant all that great.

Its a sad state of affairs in the american court systems nowadays- Mothers can do no wrong and are granted custody, the house the car alamony etc etc 90% of the time. Scott- Im burdened beyond belief right now, so much that last month I had to borrow money from family to buy medication. But I will pray for you. I will pray for your children.

Dude I sure hope this works out for you. Just so you know that sometimes the Guys do come out on the good side of this kind of thing. My ex decided she wanted to go whoring around about 6 yrs ago she waked out the door taking the car and leaving the rest behind, including the two kids. Rather than bore you with the details I'll just tell you how it ended up. She is in a half way rehab house, I have full custody of the two kids both physical and legal. That means she has no say on anything to do with he kids. She does have visitation rights but they are extremely limited and all at my discretion. Any visit she has with the kids as to be approved by me, supervised by an adult of my approval, time and length of my approval, and place of my approval. If I was in a position to help you with some $$$ I surely would unfortunately I am not but I just wanted you to know that the women dont always come out ahead anymore and us men have a fighting chance. GOOD LUCK MAN!!!!
