So, I just got called ( from my x ) and she said that I am not to pick up the kids today because they are sick...

I kinda figured that this was comming. And Pinkgirl found me info on visitation when kids are sick and it states they are still to go on their normal visitation UNLESS they are so ill that they are in the hospital...

So, in 28 minutes I am to be @ her door to pick them up. If she refuses like she said she would then it is off to the police station yet again.

man, if I have two police reports on her breaking the order, they will not look good for her

I am writing you on behalf of Loura Parker concerning the judgments enters August 2, 2002 and November 8, 2001 which award both parties joint legal custody of the minor children with sole physical custody to Ms. Parker.

As you know, Ms. Parker is moving to a new location that provides the family more room for less money, in single family dwelling with a yard instead of an apartment. She will be moving the Scot to the neighborhood school which is just a block or two away. She will also be placing both in childcare closer to her home.. Her new address is 243 E. 75th Street, Los Angeles, CA.

She told me that you have refused to agree to her changing Scot's School.. Family Code Section 3083 [Content and Effect of Joint Legal Custody Order] provides in pertinent part: "In making an order for joint legal custody, the court shall specify the circumstances under which consent of both parents is required to be obtained in order to exercise legal control of the child and the consequences of the failure to obtain mutual consent...An order of joint legal custody shall not be construed to permit an action that is inconsistent with the physical custody order unless the action is expressly authorized by the court." (Emphasis Added)

Please note that Ms. Parker has sole physical custody of both children, and although you have joint legal custody, you cannot do anything to interfere with her right to physical custody unless you obtain a court order.

She also informs me that on several occasions you have failed to return the children from their court ordered visit and kept them overnight without seeking her permission or telling her of your plans. Although Ms. Parker is may be open to providing more visitation, she is very upset when you keep the children in violation of the court order without any notice.

If you have any question, please do not hesitate to call me or have your representative call me.

ok, that last paragraph, it was written like that. I had to read it a few times....

and every time that the children have spent the night with me, she knew about it and was ok with it, minus the one time she called the police on me.

So, tomorrow morning I am going to fax this to my lawyer, he should like it.....

ok, I got a "NOTICE OF WITHDRAWAL OF ATTORNEY OF RECORD" in the mail today, so her free laywer isn't represengin her any more

So, some more Drama has gone on since I last posted....

Monday Evening, her boy friend threatened me for the second time....

When I went to drop off the kids that night, I knock on the door, no answer, I wait for almost 5 min.... I am driving away I see her boy friend sitting on the corner, well, I am NOT going to give him my kids when he is sitting there. So I just keep driving and go home. She calls all pissed off, and says that he saw me, I am like I know, I saw him & it looked like he was waiting for a drug deal to happen. she got all pissed and curses @ me, so I hang up on her. She calls me back and I am like don't talk to me like that. We go back and forth and finally she aggress to come pick them up. So when she gets here ( both kids are sleeping ) I take one child down to her and hand him to her boy friend and walk to her cat to make sure that there are two car seats in it. There are so I go back up and get the second child. I bring him down and hand him to her boy friend as well. Then he say Next time you have something to say, say it to my face, just watch, next time you go to my house you will get it.

So, when I go to get then Tues I go to the police station and tell them about the threat and what can I do because I need to go to his pad 6x a week. So we talk and I know he isn't there when I pick them up so they said just go get them and when you need to drop them off come here. So I do that. So when I am to drop them off I am @ the station, I still didn't have her phone # @ that time so it was sit and wait for her to call. So she calls "Where are the boys" I am like they are @ the police station, you need to come here and get them. She started talking and the officer asked to talk to her, so I gave him my cell. He was talking to her telling her it would be best for her to come there and get them and all that ( about 3 blocks away ) and @ first she wouldn’t go for it but finally he got her to agree to it. It then took her almost 30 min to get there, so my oldest asked her what took so long and she was like "I can't disclose that @ this time". ( ok that is lame to say to a 5-year-old ) So she is now there I just leave, no reason for me to stay.

So this AM my lawyer and her needed to go to court to arrange our hearing ( 3/17/04 ) and after he called me and told me the date and all, and he was like, supposedly there is a police report against you that you shoved a child into her boy friends arms, I was like, um ok.... my lawyer was like yeah, it is prolly BS ( well duh, of course that is, why in the hell would I shove MY child into some ones arms that I don't like )

so, yeah, that was lame......

and I get to go to court the 16th to talk to a mediator and the 17th for the hearing....

My wife and I split up last year and every time I talk to her , she is such an ass to me . I even try to be nice to her and get along with her .

Do you ever look back and think "What in the hell did I EVER see in her ?"
