Talking Heads frontman David Byrne laments his run-in with the RIAA & DMCA over at his website (via Boing Boing). Apparently a Byrne webcast featured more than 4 tracks by one artist in a three-hour period, violating the DMCA. "Back in the day I used my boom box to tape things off the radio all the time — that’s how I found out about music I didn’t know about, and eventually I not only bought those records, but ended up promoting them, too."

How is broadcasting more than 4 songs in a three hour period a violation of the DMCA? The DMCA is about circumventing copy protection schemes. Unless he got those 4 songs by ripping them from some sort of non standard protected CD I don't see how this wouldn't be plain old copywrite infringment.

Broadcasting 4 songs by the same artist in 3 hours is a violation of the DMCA. This is the rule that allows Internet radio stations to broadcast royalty free.

Yeah, it's stupid, but there it is.
