Help need advice on a transaction

hello,
this is my first post on this forum . I am having a problem with a trade. the summary as well as all the messages exchanged are below. Please advice me on what to do. I have removed the buyers name to protect his privacy.

Summary:
I sold mr XXXXX a dvd burner. since I have less fedback he asked me to ship the drive out first. I confirmed his details and then did so. I asked him to make payment only after he had tested the drive. about a weekago he verified that the drive was working. he then proceeds to tell me he is having problems getting his system to work and so on. Yesterday he sends me a message saying he sent the payment out. Immediatley follwed by another message saying he called the post office and had the cheque redirected to him . Now he wannts to return the drive based on the reason that my drive doesnt work with his hardware. . Please advise me on what to do. I have attached all his private messages.

hello XXXXXXXX,
hope you got a chance to test out the dvd burner. I really liked it lot . For best results use nero 6. flawless burning ! i even tried copy on the fly not a problem ! just make sure you have the drive and dvd rom on separate ide channels. could you let me know when you mail the cheque.

The DVD works, but not on my 64 motherboard...yet. I'm still trying. I know the DVD works because I put it in another computer and burned a cd, so it has to be the motherboard in my AMD 64 rig. I'm waiting on tech support to call back.

I finally got the drive to wrok in my computer last night, no thanks to ASUS tech support. The bad part is, I'm still not too sure what I really did. I'll send today or tomorrow. I have class tonight and a busy day at work. I have no class tomorrow, so most likely tomorrow

Sorry it has taken so long, but I just had to make sure that the drive would work in the rig that I wanted to put it in. I knew that it worked because I put it in my K7 rig(I already own the same drive for that rig), ut it had to work in my Athlon64 rig.

I hate to to tell you this, as I hated to hear it, but I cannot use this drive with the computer I planned to use it in. I finally got it to get recognized by the system bios, but it doesn't function properly. It seems Asus knew about the problem, but didn't tell me. I cannot believe that Asus knew there would be a problem with the best DVD recording drive on the market! I'm so pissed right now that I want to sell this system!! I called and had the money order sent back to me(I sent it out priority mail). I will ship the drive back to you via fedex in the AM.

I'm very sorry about this. Had I know this issue, I wouldn't have wasted your time. If there is anything I can do, please let me know. I'll leave you some heat tonight when I get back to the house. Again, I'm sorry to have wasted your time.

Once you purchased the drive I went out and bought another drive. The only reason I sold the drive is because it was too expensive for me and I didnt need the dual burner capability or the software that came with the drive. I really need the money for school. I shipped the drive first with the confidence that you had some feedback and I havent had any problems trading on this board so far, I shipped out airborne express with insurance even though I could had shipped via a slower cheaper means. I was also confident that the drive was in perfect working condition which is why I asked you to pay me after fully testing the drive. Its hard to expect when you sell a drive for it to be fully compatable with the hardware that the buyer may use. I understand that its asus fault for not making their hardware not 100% compatable, but I am pretty helpless other than the fact that I desperatley need the money and have waited almost a week since you got the drive.

I understand your arguement. An experienced trader never moves forward before a trade is done. Once I got the drive and started having trouble, I let you know right away. It wasn't as if I kept it hidden from you. The drive isn't dead, I just cannot use it because it simply doesn't work with my system. Had I know that, I would have never taken your time. If I sell something to someone, I wait until all is said and done before going forward. I understand you need money for school, and that you bought another drive. I'm sorry, but I cannot use this drive and I'm going to send it back to you. I was going to keep it and just sell it myself, but this shouldn't be my problem. As I stated earlier, I informed you of my problems as soon as I ran into them. You decided yourself to go out and buy a new drive even though you knew there could be a chance that I may not have been able to get this drive to work. When I told you the drive worked, I thought it was fine because it showed up in the system bios, but I cannot burn to/or read from the drive. There is no damage to it because I tried it in my other system, thinking I may have damaged it, and it worked fine and made a copy of the Matrix.

The bottom line is this, I can not/will not keep a drive that doesn't work for me. Therefore, I'm sending it back to you in the same condition it was sent to me. You should have it by Tuesday, if I get it out by tomorrow. If not, I'll send it Monday, next day if they can promise that it'll make it by Wednesday.

I am in the unfortunate situation that I neither have the drive or the money to bargain with.. moreover I need the money badly. My responsiblities as a seller are to ship you the item you paid for well packaged , as described in the original advertisment and ensure that it reaches you promptly. No where is it the norm that I need to ensure 100% compatability with your hardware. I really appreciate the fact that you kept me informed while you assembled the computer. but agin you must accept that I mearly wanted you to have the satisfaction that the drive was operational and not your entire system.

It is the buyers responsibility to pay the seller promptly and to check whether the items were as described or not. It is well understood that a buyer must account for his own judgement of whether the product is purchased is useful to him or not. Had i been in better state I would have gladly accepted to take the brunt for your follies as it stands I need the money urgently.

I would like to pose this question to other forum members. I will keep your identity concealed at all times . I hope they can let us reach a prompt and fair conclusion. let me know if this works for you. If you do plan to ship the drive out please compensate me for my time and the shipping charges.

have him send the drive back and refund the shipping money you paid to send it to him... then resell the drive... its not your fault it don't work with his system so you shouldn't be out the money that you paid for shipping it to him. And BTW who is this clown... if he's any kind of respectable trader he would send you the money and resell the drive. That is what i would do.

thanks for the advice. I am going crazy sitting alone, I have lost a lot of faith in trading online and I doubt i ll ever ship first agin. so far he has shown no intention that he would cover my shipping to him. this guy is a trader at anandtech. he hasnt got back to after my last message. I ll keep you all updates on how he handles this. I tried to conceal his Identification so that other people can give an unbiased judgement.

Like i said the least he can do is refund you the money for your shipping it to him... If he don't your out that money because it wouldn't work with his hardware. Which is not your fault. If he don't leave him the appropiate eval at heatware.

the Last time I was Talking to myself . I got into such a heated argument . that is why I swore I never talk to that guy again. you know what it worked now no buddy talking to me. :help

It doesn't appear that zinkpig is going to update this, so I looked at Heat...........seems that all is good. The buyer opted to keep the drive :D
