Is this a Hardware or Software Modem?

If you can't see the page, please look in ebay.com, search, search by item number, item number 2043894203

The reason I'm asking is that I won the auction assuming by the look of it that it was a hardware modem. I then received an "L" shaped modem, that was clearly a software modem. I contacted the seller and she told me she had quite a few of these and scanned another one. That one looked just like the photo in the auction. She agreed to swap. Will I be receiving a hardware modem this time
These are the instructions that came with my Thermalright SLK-800 cooler:
Assembly:
The assembly gestalltet itself just as simply as with the standard Slk-800. after the foil of the base plate was removed and the processor core with thermal compound moistened, leaves one the 6-Punkt-Halteklammer in the base noses to engage. Subsequently, the radiator box is aligned centrically on the base. By means of slotted bolt turners finally the catch side of the fixing clip down pressed to these on the base engages. A strammer contact pressure develops, whereby a good waermeaufnahme is ensured. Although the additionally existing PU Schaumpads provides for a safe seat on the processor, the PC should very carefully be transported and/or the radiators before transport be developed.

Hard to say since there's no model number but from the photo of the boardI'd say it is a hardware modem. Software modems tend to have fewer big chips.

Its a windmodem... USR only has one PCI hardware modem and that isn't it... Your best bet for a hardware modem would to get one of the Old USR Sportsters ISA cards... Or run an external modem.

I had two of the USR WIn MOdems. Both came in an exact Identical boxes from wallmart. Same price and all!
Thought I was getting two of the same modem till I opened the boxes. One was L shaped, the other a full card. Not sure what other differences there were besides using different drivers, but it ticked me off!

You buy two of something you expect two of the same thing!
