Several weeks ago I bought a BFG GeForce 6800 OC video card and it came with the game Far Cry. The card works great, no problems there, but the first CD to the game was scratched and wouldn't install. This is where the fun begins.
I called BFG to get a new set of CDs. They told me "Sure no problem, we'll send you a new set." Cool. I get a call the next day saying, "Whoops, we actually need you to send the original CDs back to us first." OK, not a big deal. So I called them up to confirm what they needed and the woman I spoke to sounded like she had to have been high. After 20 minutes of her begin thoroughly confused, I said "Screw it, I'll just send you all the CDs." So I ship them out and they arrive at BFG (delivery confirmation).
A few days later, I get a package from them that contains another video card (only). Thats right, bare card (packaged well), but no software. )* So I called them up and explained what had happened. They said "Sorry about that, we'll send you an ARS label to return the card and get you a new set of CDs shipped out tomorrow." That was three weeks ago.
So now I'm sitting on a $300 video card with no need for it. At this point I don't even care about the game: Doom 3 will keep me busy until HL2 is released. I'm tempted to just sell the card b/c its obvious BFG doesn't have their act together (tech support is outsourced to another company the the communication between the two is CELARLY not worked out). But I think should probably try to contact them one more time and say "WTF?" So what would you do in this situation?
Something of a moral dillemna...

Granted you made an honest effort and after 3 weeks I'd claim possesion if they're too stupid to followup BUT you're already on record as having informed them that you have the card, you've started a return process. I'd worry that a month down the road they'll finally figure what's going on and then demand the card back or payment for it,
Now I'd say that chances are they wouldn't bother making a case about it if you said you sold/lost/gave away/sent back the card back weeks before, so sue me. BUT legally you'd be in the wrong and if they decided to make a big deal about it (not likely, but...) they could make life a bit difficult.
So anyway if it was me it's a tossup. I'd probably try calling them one more time (assuming it's a toll free call - if it's not, screw 'em). Or I might keep the card, but keep it for myself as a spare (or put it in my LAN rig - yeah, that's a nice safe place to store it
) for a while just to make sure I don't have them hounding me for it later (umm, sure, I still have the card here - it's got some lint in the HSF, hope you don't mind...). A couple more months go by and I'd consider it mine for sure with a clear concience.
I'd hate to sell it now and then regret it later.
Then again I am cursed with a concience.
I had a mobo manufacturer ship me 4 mobos from RMA that weren't mine. Somehow someone else's account got mixed up with my shipping address in their computer and I was getting the mobos instead of whoever RMA'd them in the first place. 3 of those mobos were top of the line EXPENSIVE mobos.
I would have kept the first one - that was a cheapie that was selling new for $35, but when 3 more came in that were very pricey I contacted them. Then it took a month for them to figure out how to have me ship them back. They didn't have any facility to sent me a pre-paid label (why I dunno) and wanted me to use their UPS account number which my UPS store that I use for shipping won't allow (dang I ALMOST got 4 mobos AND a UPS account! I'm a lousy crook
).
Finally I just told them (they couldn't figure this out themselves for some reason) to schedule a pickup on their account at my UPS store. Normally the store wouldn't do that - they don't want to be responsible for something they're not shipping themselves, but they're clients of mine and I have a mail box there.
OH, PS: You DO want Far Cry. TRUST ME. Doom3 is crap by comparison. Far Cry is the most fun I've had in an FPS game since Half Life. If you end up with the card go buy the game. It's worth it. Look for the DVD version though. It's a bitch installing it on CD with all those discs.

the Last time I was Talking to myself . I got into such a heated argument . that is why I swore I never talk to that guy again. you know what it worked now no buddy talking to me.
